Warranty

This section applies to purchases made by a consumer from Solorety SIA. Your statutory rights under applicable consumer protection law are not affected by any commercial warranty offered by the manufacturer or any third party.

1. Statutory rights

If the goods supplied by Solorety SIA are defective, do not match the description, quantity, quality, functionality, compatibility or other contractual requirements, or otherwise do not conform to the contract, you have the right to submit a non-conformity claim in accordance with applicable law.

For consumers, claims regarding non-conformity may be submitted within 2 years from the date of delivery of the goods, unless mandatory law provides a longer period.

Where applicable law so provides, if a lack of conformity becomes apparent within the statutory period after delivery, it is presumed to have existed at the time of delivery, unless proven otherwise or unless such presumption is incompatible with the nature of the goods or the nature of the defect. For consumers in Latvia, this presumption applies for 1 year from the date of delivery, unless mandatory law provides otherwise.

2. Commercial warranty

Some goods may also be covered by a commercial warranty provided by the manufacturer, distributor or Solorety SIA. A commercial warranty is voluntary and additional to your statutory rights. The existence, duration, scope and procedure of any commercial warranty are determined by the warranty terms issued by the warrantor.

A commercial warranty does not limit, replace or exclude your statutory rights against Solorety SIA.

3. How to submit a claim

To submit a non-conformity claim, please contact Solorety SIA without undue delay after discovering the issue, using the contact details provided in the Contact section of the store, and follow the instructions provided by our customer support team. This does not limit your right to submit a claim within the statutory claim period.

Unless otherwise instructed by Solorety SIA, the goods should be delivered or sent to the returns address: Rankas iela 13-29, Riga, Latvia, LV-1005.

In some cases, and only if this does not limit or delay your statutory rights against Solorety SIA, you may also use an official manufacturer service centre if this is more convenient for you.

4. Documents and information

When submitting a claim, please provide, where available:

  • proof of purchase (for example, receipt, invoice, order confirmation or payment confirmation);
  • the product name, order number and a description of the defect or non-conformity;
  • photos or videos, if they help to identify the issue;
  • the commercial warranty document, if you wish to rely on a separate manufacturer or seller commercial warranty.

A manufacturer’s warranty card is required only where the consumer wishes to rely on that specific commercial warranty and such card is required by its terms. Your statutory rights may not be refused solely because a separate commercial warranty card is unavailable, provided that you can reasonably prove the purchase.

5. Remedies

If the claim is justified, Solorety SIA will provide the remedies required by applicable law. As a rule, you may first be entitled to have the goods brought into conformity by repair or replacement, unless the chosen remedy is impossible or would impose disproportionate costs compared with the alternative remedy.

If repair and replacement are impossible, not provided within a reasonable time, would cause significant inconvenience, or if the non-conformity is serious, you may be entitled to an appropriate price reduction or to terminate the contract and receive a refund, in accordance with applicable law.

Any repair, replacement, return, collection or other measure required to bring the goods into conformity will be carried out free of charge to the consumer where required by applicable law.

6. What is not covered

Solorety SIA is not liable for defects or damage to the extent they were caused after delivery by circumstances for which Solorety SIA is not responsible, including, for example:

  • improper use contrary to the manufacturer’s instructions or the ordinary purpose of the goods;
  • intentional damage or negligent handling;
  • unauthorised repair, modification or disassembly that caused the defect or made assessment impossible;
  • damage caused by external events after delivery, such as accident, fire, flood, lightning or other external causes;
  • use of incompatible accessories, spare parts or consumables, where this caused the defect;
  • improper storage, maintenance or transport by the consumer after delivery, where this caused the defect;
  • normal wear and tear expected from ordinary use, taking into account the nature of the goods.

Minor deterioration resulting solely from normal use is not, by itself, a lack of conformity. However, this does not affect your right to claim where a component, including a consumable component, fails prematurely because the goods were not in conformity at the time of delivery.

7. Consumables, batteries and parts subject to wear

Certain components, such as batteries, lamps, filters, print consumables and other parts naturally subject to wear, may have a shorter expected service life due to their nature and ordinary, reasonably expected wear. This does not exclude your statutory rights if such component was defective, not as described, or otherwise non-conforming at the time of delivery.

8. Examination of goods

Solorety SIA or an authorised service partner may inspect the goods to determine the cause of the defect and whether the claim is justified. If the inspection confirms a non-conformity covered by applicable law or by a valid commercial warranty, the consumer will not be charged for such assessment where applicable law so requires. Where applicable law so requires, the necessary costs of returning, shipping, collecting, removing or reinstalling the goods for the purpose of examination or bringing the goods into conformity shall be borne by Solorety SIA.

9. Relationship with mandatory law

If any provision of this section is inconsistent with mandatory consumer protection law, the mandatory law shall prevail and the remaining provisions shall remain in effect to the fullest extent permitted.
